For No Exposure Certification for Exclusion from NPDES Stormwater Permitting
The intent of the no exposure exclusion is to provide all industrial facilities regulated under the industrial stormwater permit, whose industrial activities and materials are completely sheltered, with a simplified method for complying with the Clean Water Act. If a condition of no exposure exists, then the facility is eligible for exemption for permitting for stormwater discharges from the facilities. Facilities wishing to take advantage of the permitting exclusion must submit the required certifications to the Department attesting to the condition of no exposure. Facilities must maintain their condition of no exposure or, if conditions change, obtain coverage under an applicable stormwater permit.

This form is to be completed by a permittee who currently retains registration under a Maryland Department of the Environment’s (MDE) NPDES general discharge permit authorizing storm and/or wastewater discharges associated with industrial activity if the permittee intends that another person assume control of permitted activities on the site or if the site’s ownership changes.
